What is a Parenting Agreement?
In NSW, a “parenting agreement” usually means either a Parenting Plan or Consent Orders. A Parenting Plan is a voluntary written agreement between parents that is signed and dated, setting out day-to-day care and decision-making for the children. It’s flexible and can be changed by consent, but it is not a court order. If you want a binding, enforceable outcome, your agreement can be formalised as Consent Orders (made by the Court, usually on the papers).
Parenting Plan
- Voluntary, in writing, signed and dated by both parents.
- Covers time with each parent, changeovers, travel, communication, decision-making, etc.
- Flexible and can be updated by consent; not enforceable as a court order.
Consent Orders
- Agreement is submitted to the Court and made into legally enforceable orders.
- Filed online with an Application for Consent Orders; most are decided on the papers.
- Orders must be in the best interests of the child.
